klipsch.co.uk hopes to make the online shopping process easy and efficient; these terms and conditions are designed to ensure your satisfaction and understanding of the purchase process.
This page sets out the terms on which Klipsch.co.uk makes available products on its website located at http://www.klipsch.co.uk (“online shop”) available for purchase online. Please take the time to read these terms and conditions carefully before making a purchase using the online shop.
By placing an order for any product, you agree to these terms and conditions. If you do not agree to these terms, please do not proceed with your order.

The online shop is operated by Klipsch Distribution UK, a company registered in Ireland under company number 444457 and with its registered office and trading address at Unit 5 Keypoint Business pk, Rosemount Industrial Esd, Ballycoolin Rd, Dublin 11 Ireland. Klipsch Distribution UK’s VAT number is IE 9689581W.

Your Status
By placing an order through the online shop you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old.
Purchases made on the online shop are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit.

Descriptions of Products
Descriptions and specifications of products on the online shop are not intended to be binding and are intended to give a general description of the products. Klipsch may make any changes in the specification or description provided that this does not materially affect the quality or performance of the products.

Klipsch warrants that it has the right to supply all the products offered by it on the online shop and that the products substantially comply with their description. In all other respects, and to the maximum extent possible, Klipsch makes no other warranties or promises about the products, and any implied warranties are excluded.

Pricing and Payment
The price of the products shall be the price listed on the online shop on the date of your order (except in the case of obvious errors or omissions), inclusive of VAT but exclusive of delivery charges which, where applicable, are payable by you.

All prices on the online shop are quoted in UK pounds sterling (£) and must be paid for in full, including delivery charges, prior to delivery. Prices may change at any time but changes will not affect orders in respect of which Klipsch has already sent a confirmation email.

Payment must be by credit or debit card. We accept payment using Visa, Mastercard, Switch, Solo and Maestro. Payment will be debited and cleared from your account upon receipt of your order by Klipsch. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Klipsch, Klipsch will not be liable for any delay or non-delivery.

How the contract is formed between you and Klipsch
After placing an order, you will receive an e-mail from Klipsch acknowledging the details of your order. Please note that this does not mean your order has been accepted. Your order constitutes an offer to Klipsch to buy the products listed in your order.

Klipsch does not promise that products are necessarily available, and all products are offered for sale subject to availability. Once Klipsch receives your order, we will check our stock for availability of the relevant items. If any product(s) are not in stock at the time of your order, you will receive an e-mail notification.

All orders are subject to acceptance by Klipsch. Unless you cancel your order in accordance with the Cancellation policy below, acceptance of your order and completion of the contract between you and Klipsch will be perfected when Klipsch despatches the product(s) to you. Klipsch will send you a print out of your order together with delivery of your products.
Klipsch may not accept your order if, for example, Klipsch is unable to obtain authorisation for payment, that the item ordered is out of stock or is withdrawn from sale or if you do not meet the eligibility criteria set out above.

Delivery
Delivery will be arranged by Klipsch using a courier or postal service. Any times for delivery on the online shop or in any correspondence to you shall be approximate and indicative only and shall not be binding upon Klipsch. Standard delivery on all products unless otherwise stated is 4-7 business days in Britain and Ireland.

Cancellation, Returns and Refunds
Klipsch hopes you will be totally satisfied with the products but if you would like to cancel your order and return the products you may do so within 14 working days after receiving them.

To cancel your order, return the products, unused, to us. Before returning please contact info@klipsch.co.uk for details. Please enclose a copy of your order confirmation and your reasons for returning the products.

Following receipt of properly returned, undamaged products, Klipsch will confirm cancellation by email and will repay to you the cost of the products within 30 days from receipt of your cancellation by crediting the original purchaser’s payment card. Klipsch will not refund the postage costs of delivery or return unless the products are faulty.

Any items returned outside the 14 working day timeframe described above will only be accepted at Klipsch’s discretion.

Limitation of Liability
Klipsch’s liability to you is limited to refunding the price of the products as provided for above. Klipsch is not responsible to you to any greater extent and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.

Nothing in these terms and conditions shall serve to exclude or limit Klipsch’s liability in respect of death or personal injury caused by Klipsch’s negligence or the negligence of its officers or employees.

Jurisdiction and Applicable Law
These terms and conditions are governed by English law. The English courts will have exclusive jurisdiction over any dispute or claim arising from or related to these terms and conditions and/or use of the online shop.

If any of these terms or conditions should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.

Variations
Klipsch may revise these terms at any time by amending this page or the relevant document. Please check this website from time to time to take notice of any changes made, as they are binding.
