Article 1: Organization

Klipsch Group Europe-France, Limited Liability Company with a capital of 6,400 €, whose registered office is located at 10 rue de Penthièvre 75008 Paris, registered with the Paris Trade and Companies Register under number 320 461 007 (hereinafter referred to as " the Organizer ") is organizing a free and no-obligation" HERITAGE "contest, which will run from April 15th to June 15th, 2019. (hereinafter referred to as the" Contest ").

Article 2 - Purpose

The aim of the competition is to allow young designers to imagine tomorrow's projects that may find their place in the Klipsch Heritage product line, and in particular:

  • Wireless speaker: the participants will have to create the wireless speaker of tomorrow in line with The One and The Three
  • Headphone: the participants will have to create the future headphone Heritage Circum-aural (over-ear)

The contest will reward two entrants for each product category, two for the Wireless Speaker category and two for the headphone category.

Talents will have to tap into the roots of the brand to imagine the products of tomorrow that may find their place in the range of products Heritage Klipsch brand. The choice of materials will be essential.

This Contest, governed by French law, falls into the category of competitions that are not random to determine the winners.

Article 3 - Conditions of participation

3.1. participants

This contest is open:

  • Students enrolled on 1 January 2019, in a school of engineering, design, industrial design or following a university course in connection with these subjects.
  • Young talents under 30 years of age as of June 15, 2019 who have a degree in one of the fields above

Participants must show proof of residence on the day of their participation in one of the following countries:

Participation in the Contest is free and open to any natural person capable, major on the date of opening of the Contest and respecting the conditions set out above, to the exclusion of all the persons who collaborated in the organization and the contest. performance of this Competition, and collaborators of the Organizer who contributed directly or indirectly to the selection of projects.

Participation in the Contest implies the express and unreserved acceptance of the present rules in all its stipulations, and in general, the laws, regulations and rules of ethics applicable to the games and contests in force in France.

Entrants to the Contest must be free from any contractual commitment to their participation in this Contest and, if applicable, in the event that they are selected at the time of this Contest, to the realization and the marketing of their Project (s). Therefore, entrants guarantee the Organizer against any actions or claims that may arise as a result of their participation in the Contest.

The Organizer reserves the right to exclude from the contest any participant who does not respect one or more provisions of the present rules. The organizer also reserves the right to sue any person who attempts to defraud or hinder the fair or impartial contest.

The Organizer may decide to cancel the Contest if it appears that obvious fraud has been committed in any form and on any medium whatsoever, particularly in a computer manner in connection with the participation in the Contest or the selection of winners.

3.2 Terms of participation

In an attempt to win the prize provided for in Article 5 of this Regulation, participants must:

  • Attach a descriptive note of the project (1 page maximum with dimensions, materials, inspiration, originality ...)
  • Download at least 3 photos (sketch and renders in .PNG, JPG or JPEG)

The file must be fully completed in English.

The projects thus submitted will be taken into account until June 15, 2019.

Each participant will be able to present only one project for each category of the contest. A participant may however submit a project in both categories of the contest.

The Organizer reserves the right to verify by any means the veracity of the information contained in the entry form. Any false declaration of a participant will result in his exclusion from the Contest and the non award of the prize that this participant could have won, or, if this participant has received an endowment, his immediate restitution, without the responsibility of the Organizer can be engaged.

Article 4 - Conduct of the Competition and Selection of Winners:

The Contest will be held in the manner specified below.

The winners will be selected by a jury made up of professionals from the sector. It will be composed of 6 members.

The jury will meet at the end of June 2019 to select two winners for each category (wireless speaker and headphones). The jury will award for each category a first prize and a second prize.

The selection criteria (cumulative criteria) applied by the jury are as follows:

- project communicated according to the terms of article 3.2;

- technical and financial feasibility of the project;

- degree of innovation of the project;

- Coherence of the project with respect to the Heritage product line

The decisions of the jury will be taken by a majority of votes, each member of the jury counting for one vote.

The decisions of the jury are sovereign and can not be contested by participants or any third party.

The organizer reserves the right to disqualify any participant whose project does not meet the requirements of the specifications / brief.

Any disqualification for any reason whatsoever results in the non-delivery of the prize to which the participant could have claimed.

Participants whose application has not been accepted will not be entitled to any compensation of any kind whatsoever.

The jury will select the 2 winners for each category of the contest.

Article 5 - Endowments

5.1 Lots offered:

For each category of the contest (Bluetooth Speaker and Headset), two prizes will be awarded:

  • 1st prize: a check of 5,000 €
  • 2nd prize: a check of 2 000 €

5.2 Allocation of lots:

Winners will be officially notified by e-mail and / or mail of their winnings. Their details will then be requested for the allocation of their lot.

Their prizes will be awarded within 2 months from the announcement of the winners in terms that will be specified to the winners when confirming winnings.

The organizer, unable to reach the winners between July 15 and August 30, reserves the right to disqualify these winners and to award the prize to a substitute.

Endowments are personal and may only be awarded or assigned to other persons to winners of the Contest.

Article 6 - Advertising, promotion of participants

The participants remain the owners of the projects submitted for the competition and their exploitation rights. It is their responsibility to protect their creation by filing a patent or model.

The Organizer declines all liability for damages resulting from negligence on the part of the participant and concerning the protection of industrial property.

The Organizer reserves the right to make these projects and the identity of the participants a use for communication or advertising purposes of which the Organizer will be the sole judge. The participants authorize the Organizer to mention the projects in press articles, advertising documents or brochures and to exhibit them in public events of their choice without limitation of duration.

For these purposes, the participants authorize the Organizer to make all copies, graphic or photographic representations of the winning and selected projects, as well as their authors, subject to mentioning their names.

The Organizer reserves the right to publicize this contest on various advertising media (electronic / paper ...).

Participants authorize the Organizer in advance to use their names and images as part of their communication, for a period of 10 years on paper, audiovisual and digital, worldwide, and this, free of charge.

Unless otherwise requested from the Organizer, participants authorize the citation of their first name, their name and / or their pseudonym and the publication of their photograph on any communication medium relating to the contest.

By participating, the participant undertakes to provide a project that respects the copyright and image rights of the people represented. Thus, the participant acknowledges having obtained all the required authorizations, in particular relating to all assignments of intellectual property rights, industrial rights, neighboring rights necessary for the exploitation of the project.

The participant guarantees the Organizer against any third party claim based on an intellectual property right, an industrial property right, a neighboring right or a lack of authorization on an element composing the submitted project.

Article 7 - Liability

Participation in the Contest implies knowledge and acceptance of the characteristics and limitations of the Internet, particularly with regard to performance or technical malfunctions, response times to consult, interrogate or transfer information, the lack of protection of the Internet. some data against possible diversions and the risk of contamination by any viruses circulating on the network.

The Organizer can not be held responsible, especially if the participation file does not reach him for any reason or if the participation file was impossible to treat, for any reason whatsoever.

By participating in the Contest, each entrant accepts and agrees to bear alone, and fully guarantee the Organizer and its partners as well as their subsidiaries and parent companies, directors, employees of this fact, any damages or losses caused or suffered by the participant by participating in the Contest, except as provided by applicable law. The Organizer and its partners assume no liability for any incidents or accidents that may occur during events that Contest participants may collaborate with.

Article 8 - Amendments to the Regulation

Article 9: Reimbursement of participation fees

The postage costs are reimbursed at the slow rate in force on simple written request. A slow rate stamp in effect will be sent to the applicant, only one refund per household will be accepted.

Article 11 - Personal data

The data collected is mandatory to participate in the Game. Therefore, persons who exercise the right to delete data concerning them before the end of the Game are deemed to have waived their participation.

By completing the form and ticking the mandatory box "I accept the payment", the participants accept, subject to the exercise of their right of opposition under the conditions defined below, that the details concerning them and that their eventual update shall be communicated to the Organizer.

Unless otherwise stated, the personal data that are communicated in connection with participation in this Game will be computerized.

The person in charge of the file is the Organizer whose coordinates are specified above. The purpose of the processing of these data is the organization of the Game as detailed in the Regulations. The recipients of this data are the persons authorized within the Organizer. A third party may be the recipient of these data if his intervention is necessary (lawyer, bailiff, notary, expert, etc.).

Article 12 – Language - Applicable law and jurisdiction

This Regulation has been entered into in both the English and French languages. In the case of any difference in interpretation between the two versions, the French language version shall prevail in all respects.

This regulation is subject to French law.

Any litigation arising out of this Contest which can not be settled amicably will be submitted to the competent courts of the jurisdiction of the Paris Court of Appeal.
